BACKGROUND APPLICANT: LOCATION: Erickson Super Va1u Generally north of Rice Creek Road and west of Silver Lake Road. Front yard setback is 30 feet and must be landscaped. The zoning code defines the front yard as that yard adjacent to a public street. In this case it appears that the front of the building or main public entrances is on the north side of the building. If the yard north of the building were to be designated the front yard there would have to be thirty feet of landscaping. From a zoning standpoint I recommend that the Planning Commission designate the Rice Creek Road yard as the front yard. The approved condominium building immediately to the west has its front yard on Rice Creek Road and these two sites should conform. The zoning code requires that there be a 25 foot buffer landscape strip between a B-3 district and a R-2 district. The west boundary has at maximum a 20 foot strip. The area will have to be expanded to 25 feet. From scaling off the plans, staff feels that providing a 25 foot strip would only cause a problem in one area on the southwest corner of the building where there appears to be an entrance with stairs. This area will have to be addressed. In regard to the landscaping indicated, the winged euonymous must be pl~nted close enough to create a hedge and must be at least 4 feet in height when planted. The zoning code requires a 41 to 61 hedge or fence within the buffer area. The landscaping proposed would be adequate if properly done.
