Front yard setback is 30 feet and must be landscaped. The <br />zoning code defines the front yard as that yard adjacent <br />to a public street. In this case it appears that the front <br />of the building or main public entrances is on the north <br />side of the building. If the yard north of the building <br />were to be designated the front yard there would have to be <br />thirty feet of landscaping. From a zoning standpoint I <br />recommend that the Planning Commission designate the Rice <br />Creek Road yard as the front yard. The approved <br />condominium building immediately to the west has its front <br />yard on Rice Creek Road and these two sites should conform. <br />2. The zoning code requires that there be a 25 foot buffer <br />landscape strip between a B-3 district and a R-2 district. <br />The west boundary has at maximum a 20 foot strip. The <br />area will have to be expanded to 25 feet. From scaling off <br />the plans, staff feels that providing a 25 foot strip <br />would only cause a problem in one area on the southwest <br />corner of the building where there appears to be an entrance <br />with stairs. This area will have to be addressed. In <br />regard to the landscaping indicated, the winged euonymous <br />must be plillnted close enough to create a hedge and must be at <br />least 4 feet in height when planted. The zoning code requires <br />a 4' to 6' hedge or fence within the buffer area. The <br />landscaping proposed would be adequate if properly done. The <br />accent of the Black Hills Spruce is a good concept, however, <br />if the winged euonymus when planted is 4 feet hig~ the spruce <br />should be planted with a height of at least 51 to provide <br />the accent and screening. <br /> <br />~ <br />
