<br />Dear Jim:
<br />
<br />At our meeting on Wednesday, December 8, 1982, it was agreed that your
<br />legal cou.nsel would prepare an addendum to the Development Agreement
<br />for New Brighton City Council approval reflecting additional obligations
<br />by the city to encourage Phase 2 development of our expansion project
<br />easterly and Phase 3 development along the westerly property line. The
<br />Phase 2 city obligation would be site preparation costs on a not-to-
<br />exceed $80,000 basis upon completion of further soil tests and, similarly,
<br />on Phase 3 amenities. The Lease Purchase Agreement would be modified
<br />to reflect the addendum to the Development Agreement prior to the
<br />City Council Meeting on December 14, 1982, to assure understanding and
<br />acceptance by the city which is in our mutual interests.
<br />
<br />Your efforts to obtain the Highway Department permits for berming is
<br />greatly appreciated and critical to our effectiveness. The four condi-
<br />tions are:
<br />
<br />-Removal and replacement of the fence
<br />-Appropriate handling of the trees and shrubs
<br />-Arsenal access to force main
<br />-Parking elevation by Barr Engineering
<br />
<br />site preparation already completed will be impacted by the last condition
<br />and warrants further consideration and assistance by ~he city with dis-
<br />covery of the force main and related conditions. Per our understanding
<br />and agreement, you will see that these items are resolved. If you have
<br />further questions, do not hesitate to contact me.
