If the Council revokes their license, then <br />limber Crest can apply for a provisional license with the City. A provisional <br />icense also requires that Timber Crest submit a mitigation plan to the <br />ouneil for approval. Officer Paetznick stated that not all calls would be <br />onsidered; primarily those that that are criminal in nature, or negatively <br />affect quality of life for residents and/ or neighbors. It was reported that <br />Timber Crest Apartments has exceeded the allowable amount of calls for <br />service, the recommendation was made to go forward with the revocation of <br />Multiple Dwelling license for Penrod Lane LLC. <br /> <br />Mayor Larson stated in the past this ordinance has proven effective, <br /> <br />Director Jacobson confirmed that the City will continue to work with <br />property owners to assure a safe environment. <br /> <br />Council Member Bauman questioned the intensity of the crimes committed. <br />It was reported there were three felony level assaults. <br /> <br />Joel Seltz, Legal Representative for Penrod Lane LLC stated that there were <br />as many as ten police reports where he felt the nature of the crime should <br />not qualify under provisional license status. <br /> <br />~ounci1 Member Doffing stated that a crime free zone is owed to residents, <br /> <br />~unci1 Member Burg commented that Public Safety has seen great success in the <br />past with this approach, and agreed with COlll1ci1 Member Doffing on the City's <br />obligation to its residents, <br /> <br />Mayor Larson gave an opportunity for additional questions or comments. <br /> <br />There were none. <br /> <br />Council Member Doffing called the question and made a motion to <br />to approve the resolution for revocation of the regular Multiple Dwelling license- <br />Penrod Lane LLC, seconded by Council Member Hoffman <br /> <br />5 Ayes - 0 Nays, Motion Carried <br /> <br />I 2. Currently there is access to Lake <br />Diane through her lot. The resident is requesting the easement not be included, The <br />City requires a ten foot easement. There were neighbors concerned about how the <br />lake would be accessed if not through Ms. Whitchurch's lot; subsequently the <br /> <br />2.
