<br />-3- <br /> <br />(~. <br />..,..oI' <br /> <br />The zonIng code requIres that all constructIon other than single <br />family and two famIly dwellIngs submit to sIte plan review and <br />appr9val from the City. In this case, the townhomes receIved <br />site plan approval, LP-145, at the time of final PRO and plat <br />approval. However, Section 8-040 of the zoning code states sIte <br />plan approvals shall expire within 180 days If not used or an <br />extension granted. The applicant in this case did not apply for <br />any extensions. The applicant is now planning to begin <br />construction of the townhomes this summer and has thus reapplied <br />for site plan approval as required. <br /> <br />Except for the lack of,a22 foot drIve area through the site, all <br />of the orlnginal concerns for the townhome developement have <br />been met: <br /> <br />1. Rice Creek Watershed District approval has been granted. <br /> <br />2. The association covenants and declarations have been <br />submitted and reviewed by the City Attorney. <br /> <br />3. The landscape plan shows additional berming and <br />landscaping along the western edge of the town home <br />property, including Black Hills spruce trees. <br /> <br />4. Access easements have been provided to Outlot A, Silver <br />Oaks 4th AdditIon. There is a 20 foot easement <br />between lots 3 and 4, and a 40 foot easement along <br />the rear of lots 2, 3 and 4, Silver Oaks 6th Addition. <br /> <br />5. The western most finger of the town home site has been <br />left in a passive nature and does not include a swimming <br />pool. <br /> <br />6. A garage that was existing on the site has been removed. <br /> <br />7. The radius of the cul-de-sac in the townhome <br />development has been increased to enable access room for <br />emergency vehicles. <br /> <br />The applicant has stated that the driveway through the townhome <br />development will be increased to 22 feet, as required. <br /> <br />The submitted plans contain all the required information. <br />landscape plan is complete and provides for the necessary <br />and a variety of vegetation. The units appear attractive <br />although the color and use of exterior materIals have not <br />specified on the plans.
