<br />PAGE 2 <br /> <br />In the attached letter, the applicant states that the following <br />will be done to address the existing Type IV nonconformities: <br /> <br />l. The side yard setback, along the south property line, will be <br />made conforming along 95 feet of its frontage. <br />2. The parking will be expanded for eight more spaces. <br />3. The outdoor garden center will be reduced in size to allow <br />for an additional 10 foot front yard setback. <br /> <br />The applicant has also indicated the following will be done: <br /> <br />1. Concrete curbing added where it presently does not exist in <br />the front parking lot. <br />2. Asphalting of the driveway along the north side of the <br />building. <br /> <br />STAFF ANALYSIS OF TYPE IV NONCONFORMITIES <br /> <br />On June l4, 1986, Chenoweth Greenhouses suffered a fire in the <br />greenhouse area of their business. Because of, the above noted <br />nonconformities, the applicant is required to obtain a <br />nonconforming use permit. The applicant in this case feels a <br />sense of urgency to complete the approvals process by August 1, <br />1986. Twenty-five percent of the applicant's business is done <br />during the Christmas season. Construction of the greenhouses <br />must begin the first part of August in order to be ready for <br />their Christmas growing season. <br /> <br />The applicant is proposing to reduce the total number of <br />nonconformities and reduce the scope of the nonconformities where <br />practical. It is my opinion that the applicant's proposal to add <br />the required concrete curbing, provide additional parking and <br />increase the side yard setback for a portion of the building <br />along the south property line meets the requirements for a <br />nonconforming use permit. It appears there is no way to provide <br />additional setbacks and green area along Old Highway 8 without <br />eliminating needed parking. The applicant has shown additional <br />planting along the north property line. <br /> <br />STAFF ANALYSIS OF SITE PLAN <br /> <br />The site plan indicates that the 22,365 square feet of new <br />greenhouse space will conform to the required setbacks. All ~ <br />construction will take place in the rear of the property, behind <br />the existing retail space along Old Highway 8. Six additional <br />parking stalls are shown along the north side of the greenhouse. <br />The temporary garden center indicated on the plans is operated May <br />through mid-July. <br /> <br />All of the required information has been presented except for a <br />landscape schedule and proposed grading and drainage. The <br />building elevations are shown in typical form in the enclosed <br />manufacturer's brochure. <br />
