<br />. <br /> <br />Femelius replied that the site plan that was provided does not alter the screening on the site; <br />there is currently a berm that helps screen the location. <br /> <br />Delaune suggested that the entire process of rezoning will address all of these issues and will <br />look at the future uses of the site. Femelius replied that the future use of the site will not be <br />addressed; the City will only know the type of business that is proposed to be run on the site. <br />The Council can limit some aspects such as the height of the piles and hours of operation, and <br />review and regulate any future uses. Delaune asked whether the company would be required to <br />obtain another approval. Femelius replied that any change of use, including intensifying the use <br />on the site, would mean that they would have to go through the Planning Commission and then <br />the Council. <br /> <br />. <br /> <br />Benke asked if there were any consequences of not allowing Midwest Asphalt to move to the <br />Belair site. Femelius replied that he does not know of any consequences. Midwest Asphalt <br />received a settlement for their business and land from the City, and the move to the Belair site <br />was not part of the settlement. Benke inquired if the company will be moving at the end of the <br />season. Femelius replied that Midwest Asphalt will move off the site at the end of December, <br />but they do have the option of leaving several pieces of their large equipment on the site until <br />July 2007. Femelius replied that Belair and Midwest Asphalt used the relocation of Ferrellgas to <br />help sell the move to the City Council. However, the City has no control over Mounds View's <br />decision, which may oppose the move and the expansion of the railroad up to the Tyson site. <br />The City Council has a great deal of discretion to decide if they want this type of use in the City. <br />Black added that the railroad would probably not expand just for Ferrellgas. Sculthorp inquired <br />if the current use on the Belair site is in violation of the light industrial zone. Femelius replied <br />that they are not in violation; they are operating under a special use permit. He added that staff is <br />not sure that they could recommend approval ofthis proposal. <br /> <br />Dump <br />Black reported that Barr Engineering is working on the dump closure plan. There is some <br />thought of adjusting the alignment of the street on the westem edge of the pond in order to save <br />money on excavation. Geoff Martin of DSU will be looking at possible changes to the site plan, <br />but will not be changing it too much. Kaufhold inquired if they can put a holding pond over the <br />dump material. Black replied that there is a proposed holding pond over the dump that will be <br />lined to prevent infiltration. Kaufhold stated that he is worried about gases from the dump. <br />Black replied that there will be a system to address the methane gas and draw it away from the <br />pond. <br /> <br />. <br /> <br />Housing <br />Black reported that the housing site is moving along well. Harmon said that she went to the sales <br />center and was impressed with the staffing levels and materials. Nelson asked if the sales agents <br />have the site plan for the entire development. Harmon replied that they have only plans for the <br />condos. Sculthorp inquired when they will start construction and if they will have to go through <br />the Planning Commission. Black stated that construction will start when the condos are fifty <br />percent pre-sold and the developers already received site plan approval. <br /> <br />Page 2 of5 <br />
