Page 6

proposed weigh scale, is used mainly during the spring for 3
months. The site plan proposes the weigh house and weigh scale be
located 6.2 feet and 4 feet from the railroad spur, respectively.

According to Mr. Ron Mattson, Assistant Director of the Minnesota
Department of Transportation, Railroad Division, The State Statues
219.45 through 219.53 require all structures and improvements
exceeding 6 inches above grade to be setback 8.5 feet from the
center of the railroad track. The proposed weigh house and weigh
scale as shown on the applicant's site plan would comply with the
above State Statutes. Any variation from these State Statute
guidelines would need to be approved by the Minnesota
Transportation Regulation Board.

It should also be noted, truck drivers would be weighing their own
trucks. This means a truck would park on the scale, the driver
would walk across the tracks to the weigh house to obtain the
truck weight, and then return to the truck and exit the scale
area.

Use Particulars

7. The proposed weigh scale would be a 10 foot by 10 foot axle scale
with a 40 foot paved approach drive and a 40 foot paved return
drive. The weigh house would measure 5 feet by 5 feet (25 sq.
ft.) and would house a digital weight indicator. the weigh house
would have a slanted roof and be sided in yellow to match the
existing office, lumber treatment building, and the to-be-sided
lumber storage buildings.

Landscaping

8. The applicant did not provide staff with a landscaping plan since
no internal landscaping was required of the applicant in
conjunction with the previous site plan reviews and non-
conforming use permits. Also, in 1983, the site non-conformities
were found to be reduced to the furthest extent practical except
in the area of dust control.

Public Works Department

9. The City Engineer has no objection to the proposed truck weigh
scale. 5th Avenue NW and County Road E-2 are state aid roads with
no restricted access in terms of weight during spring load limits.

These roads are designed to accommodate vehicles with weight loads
of up to 9 tons per axle or 45 tons total for a 6 axle truck.

Minnesota Pollution Control Agency

10. According to Mr. Mark Lahtinen of the Hazardous Waste Division, if
the scale is approved, the applicant should not be allowed to
remove any excavated soils from the site. These newly excavated
soils need to be tested for pentachlorplenal and should be stored
