<br />Page 5 <br /> <br />9. Curbing: Poured-in-place continuous concrete curbing would need <br />to be provided along the west and north portions of the <br />existing parking area. The proposed parking area would <br />include concrete curbing. <br /> <br />10. Play Area: A new bituminous play area is proposed to the south of <br />the school building and would be setback 30 feet from the <br />13th Street NW ROW. <br /> <br />11. Landscaping: An additional poplar tree would be added along the <br />east side of the existing building. The proposed landscape <br />median at the front of the proposed parking area would contain <br />a maple tree, Colorado Blue Spruce, and Buffalo Juniper. <br /> <br />12. Impact on Surrounding Land Uses: The impact of Pike Lake School <br />on the surrounding residential uses would be reduced through <br />the provision of 20 additional parking stalls; the parking <br />overflow would be accommodated. <br /> <br />13. Other Considerations': <br /> <br />SECTION 8-130 Special Use Standards <br /> <br />No special use shall be recommended by the Planning Commission <br />unless such shall find: <br /> <br />a. That the establishment, maintenance or operations of the <br />special use will not be detrimental to or endanger the public <br />health, safety, morals or comfort of the general welfare. <br />b. That the special use will not be injurious to the use and <br />enjoyment of other property in the immediate vicinity for the <br />purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the <br />normal and orderly development and improvement of the <br />surrounding property for uses permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or <br />necessary facilities have been or are being provided. <br />e. That the special use shall in all other respects, conform to <br />the applicable regulations of the district in which it is <br />located. <br /> <br />SECTION 8-460 RegUlations as to Type IV Non-Conformities <br /> <br />a. Where type IV non-conformities are present and are proposed to <br />continue, expansion of the existing structure, construction of <br />new structures, or resumption of use after discontinuance of <br />use for six or more months, shall be the allowed only upon <br />permission of the City Council. The procedure (not <br />conditions) shall be the same as that for a variance (Sec. 8- <br />220) . <br />b. Such permission may be granted only if one or more of the <br />following conditions are met: <br />(1) The total number of non-conformities is reduced; <br />
