<br />. . <br /> <br />.. <br /> <br />'" <br /> <br />RESOLUTION NO, 87-_____ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A NON- <br />CONFORMING USE PERMIT NC-76. <br /> <br />WHEREAS, an application for a non-conforming use permit, NC-76, has been <br />made by Independent School District No. 621 (Pike Lake Elementary School) to <br />permit the construction of a 11,505 square foot school addition on a site <br />with Type IV non-conformities. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An. application for a non-conforming use permit, NC-76, was filed- <br />with the City of New Brighton on April 3, 1987. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on April 21, 1987, and all persons present at <br />the hearing were given an opportunity to be heard. <br /> <br />3. The City Council reviewed the non-conforming use permit application <br />on May 12, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact i,~,respect to NC-76: <br /> <br />1. The following Type IV non-conformities exist on the property: <br /> <br />i <br />I <br />i <br />I <br />I <br />P <br />I <br />I <br />I <br />I <br />I <br />., <br />I <br />, <br /> <br />A. Lack'of poured-in-place continuous concrete curbing along the <br />north and west side of existing parking area. <br /> <br />B. Parking area within front yard setback area. <br /> <br />2. The subject site is zoned R-1, Single Family Residential. <br /> <br />3. Section 6-350 (e) of the Zoning Code requires poured-in-place <br />concrete curbing around all parking areas serving institutional <br />developments. <br /> <br />4. With the provision of concrete curbing around existing parking <br />areas, the applicant would have done everything practical to <br />eliminate and reduce the existing Type IV non-conformities. <br /> <br />BE IT FURTHER RESOLVED, the application NC-76 is hereby approved subject i <br />to the following conditions: <br /> <br />1.
