RESOLUTION NO. 87-_____ STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT APPROVING VN-255, FOR BEISSWENGER HARDWARE. wHEREAS, as application for a variance, VN-255, has been made by Beisswenger Hardware; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a variance was filed with the City on April 3, 1987. 2. That the City Council, pursuant to published and mailed notices, held a public hearing on April 21, 1987, all persons present at the hearing were given an opportunity to be heard. 3. The application for a variance was reviewed by the City Council on April 28, 1987. NOW THEREFORE BE IT RESOLVED by the city Council that the following Findings of Fact are made in respect to VN-255: 1. That the subject property is zoned I-3, Limited Industrial. 2. That the required street yard setback for off-street parking areas in the I-3 district is 40 feet. 3. The subject lot is irregular in shape. 4. The northeast portion of the proposed off-street parking area would be setback 29 feet from the Old Highway 8 ROW. 5. The applicant is requesting an 11 foot setback variance. 6. The variance would not diminish the green area or obstruct traffic visibility along Old Highway 8. 7. That the applicant has demonstrated unique and unusual circumstances and undue hardship. BE IT FURTHER RESOLVED that application VN-252 is and hereby approved subject to the following conditions: 1. Approval of LP-210. Adopted this 28th day of April, 1987.
