<br /> <br />RESOLUTION NO. 87-_____ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING VN-255, FOR BEISSWENGER <br />HARDWARE. <br /> <br />wHEREAS, as application for a variance, VN-255, has been made by <br />Beisswenger Hardware; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a variance was filed with the City on <br />April 3, 1987. <br /> <br />2. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on April 21, 1987, all persons <br />present at the hearing were given an opportunity to be heard. <br /> <br />3. The application for a variance was reviewed by the City Council <br />on April 28, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED by the city Council that the following <br />Findings of Fact are made in respect to VN-255: <br /> <br />1. That the subject property is zoned I-3, Limited Industrial. <br /> <br />2. That the required street yard setback for off-street parking <br />areas in the I-3 district is 40 feet. <br /> <br />3. The subject lot is irregular in shape. <br /> <br />4. The northeast portion of the proposed off-street parking area <br />would be setback 29 feet from the Old Highway 8 ROW. <br /> <br />5. The applicant is requesting an 11 foot setback variance. <br /> <br />6. The variance would not diminish the green area or obstruct <br />traffic visibility along Old Highway 8. <br /> <br />7. That the applicant has demonstrated unique and unusual <br />circumstances and undue hardship. <br /> <br />BE IT FURTHER RESOLVED that application VN-252 is and hereby <br />approved subject to the following conditions: <br /> <br />1.
