<br />. <br />. .... Chapter X-3 <br /> <br />g. Warning and Disclaimer of Liability. This chapter does not <br />imply that areas outside the floodplain districts of land uses permitted <br />within such districts will be free from flood damages. This chapter <br />shall not create liability on the part of the City of New Brighton .or <br />any officer or employee thereof for any flood damages that result <br />from reliance on this chapter or any administrative decision lawfully <br />made thereunder. <br /> <br />h. Severability. If any section, clause, provision, or portion of <br />this chapter is adjudged unconstitutional or invalid by a court of <br />competent jurisdiction, the remainder of this chapter shall not be <br />affected thereby. <br /> <br />i. Definitions. unless specifically defined below, words or phases <br />used in this chapter shall be interpreted so as to give them the same <br />meaning as they have in common usage and so as to give this chapter its <br />most reasonable application. <br /> <br />(1) Accessory use or structure: A use or structure on the same lot <br />with, and of a nature customarily incidental and suborcfinate to, <br />the principal use or structure. <br /> <br />(2) Flood: A temporary rise in stream flow or stage that results in <br />indunation of the areas adjacent to the cha~nel. <br /> <br />(3) Flood frequency: The average frequency, statistically determined, <br />for which it is expected that a specific flood state of discharge <br />may be equalled or exceeded. <br /> <br />(4) Flood fringe: That portion of the floodplain outside of the <br />floodway. "Flood fringe" is synonymous with the term "flood- <br />way fringe" used in the flood insurance study. <br /> <br />'. <br /> <br />(5) Floodplain: The areas adjoining a watercourse which have been <br />or hereafter may be covered by the regional flood. <br /> <br />(6) Floodproofing: A combination of structural provisions, changes, <br />or adjustments to properties and structures subject to flooding <br />primarily for the reduction or elimination of flood damages. <br /> <br />(7) Floodway: The channel of the watercourse and those portions of <br />the adjoining floodplains which are reasonably required to carry <br />and discharge the regional flood. <br /> <br />(8) Obstruction: Any dam, wall, wharf, embankment, levee, diMe, pile, <br />abutment, projection, excavation, channel rectification, culvert, <br />building, wire, fence, stockpile, refuse, fill, structure, or <br />matter in, along, across, or projecting into any channel, water- <br />course, or regulatory flood hazard area which may impede, retard, <br />
