<br />Page 8 <br /> <br />w. <br /> <br />A canopy will be constructed over the western pump islands. <br />The canopy will meet the required 30 foot front yard setback <br />requirements. <br /> <br />The nonconformities which have been addressed by the applicant <br />and in this staff report would be an improvement to the existing <br />site. These improvements will reduce the impact of the <br />nonconformities on adjacent premises and reduce the extent of the <br />existing Type IV nonconformities where practical. <br /> <br />- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - <br /> <br />~.. As mentioned earlier, an identical site plan and nonconforming use <br />permit was approved by the City-GounGi.l~.in 1985. The previous <br />pprovals expired when the applicant did not obtain a building permit <br />within 180 days of council action. Staff would recommend approval of <br />LP-221 and NC-83 based on 1) the applicant's proposal to reduce the <br />number of Type IV nonconformities, and 2) previous Council approval. <br /> <br />~At the Planning Commission meeting on November 17, 1987, the applicant <br />agreed to provide 5 additional parking stalls along the west side of <br />the existing building. The additional 5 stalls would allow the <br />applicant to comply with the required B-3 district parking standards of <br />14 stalls total; only 9 stalls total were proposed as part of the 1985 <br />site plan. <br />
