<br />II <br /> <br />\0::- <br /> <br />,. <br /> <br />RESOL UT I ON NO. 84-124 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRELIMINARY <br />PLANNED RESIDENTIAL DEVELOPMENT PRD-40 FOR WATER RIDGE PLAZA. <br /> <br />WHEREAS, an application :for a preliminary planned residential <br />development PRD-40 has been made by CBA Residential Development <br />Ltd. and Cimarron Capital Corporation; and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. <br /> <br />That an application for a preliminary PRD was filed with <br />the City on June 14, 1984. <br />Th~t the Pl~~nl!l_g__ Commi:5_~jon., purs~ant to publ ished and <br />mal1ed notlces,herd a publlC hearlng on June 19~ 1984~ <br />all person's present at the continued hearing on Jurie 19~ <br />1984, were given an opportunity to be heard. <br />That the Planning Commission continued the public hearing <br />and that all persons present at the continued hearing on <br />July 17,1984, were given an opportunity to be heard. <br />That the developer requested and was granted a continuation <br />of the July 17, 1984 public hearing to August 21, 1984 at <br />which time all persons present on August 21, 1984 were <br />given an opportunity to be heard. <br />That such application was reviewed by the City Council on <br />August 28~ 1984 and the written comments and analysis of <br />the City staff and the Planning Commission minutes and <br />recommendation were considered. <br /> <br />2 . <br /> <br />3 . <br /> <br />4. <br /> <br />5. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to PRD-40; <br /> <br />.8. <br /> <br />10. <br /> <br />11 . <br /> <br />1. <br /> <br />That the property in question is 6.26 acres in size and <br />is located generally along the south side of lOth Street <br />between 8th Avenue and 11th Avenue including the vacant <br />land on either side of 9A Avenue between 8th Street and <br />10th Street. <br />That the site presently contains 6 single family homes <br />and 12 vacant parcels. <br />T hat th e pro j e c tar e a i s pre s en t 1 Y z 0 n e d R - 1 ~ Sin g 1 e <br />Family Residential. <br />That the surrounding properties are zoned single family <br />residential, two-family residential and multiple family <br />residential and are currently occupied with single family <br />homes, apartments, and the 1-694 freeway. <br />That the New Brighton Comprehensive Plan proposed land <br />use map designates the site for single family residential <br />purposes. <br />That the New Brighton Comprehensive Plan designates the <br />site directly north of the proposed PRD site for two <br />family residential purposes with an alternative for com- <br />me rc i a l---aev eTb'-p-ril-en t .------------ <br />That the applicant has petitioned for approval of rezoning <br />of the site from the existing R-l, Single Family <br />Residential classification to R-3B Multiple-Family <br />Residential classification, and has petitioned for approv- <br />al of rezoning of the site directly north of the PRD site <br />from the existing R-2, Two-Family Residential classifica- <br />tion to B-3, General Business classification. <br />That the proposed PRD is inconsistent with the Comprehen- <br />sive Plan in terms of the proposed development as a <br />multiple family density project. <br />That in view of the proposed rezoning of the area north <br />of the PRD to B-3, which is consistent with the Compre- <br />hensive Plan, the R-3B zoning developed under a PRD would <br />be consistent with the surrounding land uses. <br />That the soil conditions of the site are extremely poor <br />and that the high cost of soil corrections make it <br />difficult to develop the entire site at a single-family <br />residential density. <br />That the __Cj_t..'L___CQun~jJ _____ has r~c?mmended tha~ the <br />Comprehensive Plan be amended to dlslgnate the slte as <br />appropriate for an R-3B zoning subject to the following <br />conditions: <br />a.
