Lange topermi t the cons truct ion <br />of a building addition on property located at 1211 Old Highway <br />#8, and <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for a non-conforming use permit <br />NC-28 was filed with the city on March 15, 1978. <br /> <br />2. <br /> <br />That the Board of Review heard and reviewed the <br />application at its meeting of March 21, 1978. <br /> <br />II <br />I <br />I <br />I <br />II <br />Ii <br /> <br />.' <br /> <br />3. <br /> <br />That the city Council, pursuant to published and <br />mailed notices, held a public hearing on April 11, <br />1978, to consider the application. All persons <br />present at the hearing were given an opportunity <br />to be heard. <br /> <br />4. <br /> <br />The written comments and analysis of the City <br />Planner, the Planning Corrunission minutes and <br />recommendation and all person's statements made <br />at the public hearing were considered. <br /> <br />I <br />I <br />! NOW THEREFORE BE IT RESOLVED by th~ Council of the City <br />Ii of New Brighton that the following findings of fact are made <br /> <br />I !~I!. <br />in respect to NC-28: <br /> <br />II <br />'I <br />I <br />I <br /> <br />1. <br /> <br />That the following Type IV non-conformities exist on <br />the property: <br /> <br />A. <br /> <br />There is no concrete curping along the driveway <br />,in the front yard. <br /> <br />d <br />,. <br />I <br />Ii <br />!i <br />I <br />d <br />Ii <br /> <br />B. <br /> <br />- - <br />, - <br />The front yard is used for parking which is not <br />permitted in an industrial district. <br /> <br />:1 <br /> <br />c. The entire front yard is not landscaped. <br /> <br />D. The existing building has less than the required <br />15 foot side ya~d setback. <br /> <br />2. That site and landscape plans submitted indicate the <br />following in respect to the non~conformities: <br />
