~ ,
~
I
,
~

~
LP-93, KC-41
Page #2

4) Lack of concrete curbing along driveways.
(Section 12-060,a.)

In accordance with the conditions setforth in
NC-36, the applicant has done the following
to eliminafe the ~on-conformities mentioned
above:

1 )
2)
3)

Placed concrete curbing along the driveways
to the front building line; and '
Removed the three parking spaces extending
into the front yard; and
Provided a 4 to 6 foot berm along 9th Avenue
S.W. to screen the outside storage of
material; and
Agreed that the concrete block wall facing
Old Highway #8 will remain painted.

4)

According to Section 3-60 of the New Brighton Zoning Code, where Type
IV non-co formities are present and are proposed to continue, new
construct on shall be allowed only upon permission of the City Council.
Since the non-conformities of off-street parking on a street side in
an industrial district and of the exterior wall treatment along Oid
Highway #8 are proposed to continu~,the applicant must have approval
of a non-conforming use permit before a building permit can be issued
for the proposed building. '

The applicant maintains that it would not be practical to change the
exterior wall treatment of the existing building and to relocate the
parking area. The applicant has however indicated that slats would
be placed in the existing chain link fence along the southwestern edge
of the property to better screen the outside storage of material.

In general, the applicant eliminated and/or reduced the impact of
the existing ~on-conformities in the applicati,on f~r NC-36 with the
exception of providing additional screening by slatting the chain
linke fence on the southwestern porti6n of the site.

The request for a building permit is for the construction of a 7,500
square foot metal storage building. Also included in the request is
an extension of the existing bituminous surface with a turn around
loop provided, the relocation of the existing rail-sp~r to the north-
ern boundary of the property and a ne~ loading dock (16' x 80')
adjacent to the relocated rail spur. With the exception of the
previously mentioned Type IV non-conformities, the site and landscape
plans as submitted contain all necessary information and conform with
all zoning code regulations.
