Commission, pursuant to published and mailed notices, <br />held a public hearing on September 20, 1988, and all persons <br />present at the hearing were given an opportunity to be heard. <br /> <br />The property is zoned 1-2, Heavy Industrial. <br /> <br />.., <br />(... <br /> <br />The required street sideyard setback for an off-street parking lot <br />in an 1-2 district is 40 feet. <br /> <br />3. <br /> <br />The proposed off-street parking lot adjacent to 2nd Street NW would <br />be setback 16 feet from the 2nd Street NW right-of-way. <br /> <br />4. <br /> <br />The applicant is requesting a 24, foot setback variance. <br /> <br />5. <br /> <br />The subject off-street parking lot is designed to allow the parking <br />of vehicles 40 feet from the 2nd Street NW right-oi-way if measured <br />from the most southerly portion of the stall to the right-of-way. <br /> <br />6. <br /> <br />The location of parked vehicles 40 feet from the 2nd Street right- . <br />of-way and the provision of boulevard trees and a 3 foot high <br />landscaped berm would cause the reduced setback to have a minimal <br />impact on surrounding land uses and 2nd Street NW. <br /> <br />7. <br /> <br />The combination of landscaping and berming along the 2nd Street NW <br />boulevard and the parking of vehicles 40 feet from the 2nd Street <br />NW right-of-way, meets the intent of the 40 foot setback <br />requirement by serving to buffer the off-street parking area from <br />the public right-of-way. <br /> <br />8. <br /> <br />The apparent hardship and unique and unusual circumstance is <br />created by the linear shape of the subject corner lot and the <br />proposed use of 2nd Street NW as an industrial roadway for <br />employee, client, and truck traffic generated by the uses within <br />Brighton Corporate Park. <br /> <br />II BE IT FURTHER RESOLVED, the app 1 i cati on for VN-267 is hereby <br />recommended for approval conditioned on: <br /> <br />II 1.
