<br />Page 7 <br /> <br />the City Council may permit such a setback without the need for a variance <br />providing it is determined no adverse impacts would be created. <br /> <br />The applicant states an undue hardship was created when Ramsey County required <br />a right-of-way dedication of 17 feet along Silver Lake Road and 16.5 feet along <br />County Road E, thus reducing the size of the subject si,te substantially. The <br />proposed site plan would comply with all setback standards if the additional right- <br />of-way dedication was not required. Additionally, the 25 foot parking setback from <br />the east and south property lines further reduces the amount of off-street parking <br />area on the subject site. <br /> <br />The proposed site plan would improve the appearance of the subject site, increase <br />the landscape screen along the east and south property lines, improve the drainage <br />patterns of the subject site, and provide for additional right-of-way along Silver <br />Lake Road and County Road E for future road improvement projects'. Due to the <br />fact the subject lot is a corner lot and abuts residentially zoned property, larger <br />than normal setbacks .are required. The applicant has attempted to comply with the <br />required setbacks, however, the paved maneuvering areas along Silver Lake Road <br />and County Road E would encroach into the setback areas. These front yard and <br />side street yard areas should be bermed to further screen and reduce the impact of <br />the off-street maneuvering areas from the public way and thus meet with the intent <br />of the 30 foot front yard and side street yard setbacks. Considering the above <br />information, it would appear a unique circumstance exists and an undue hardship <br />has been created concerning the subject site. <br />
