TO <br />PROVIDE LANDSCAPE ARCHITECTURAL/ENGINEERING SERVICES FOR <br />THE OLD HIGHWAY 8 CORRIDOR FOR PHASE RELATING TO CONCEPT <br />(I, TREE PLANTING (11) AND ENTRANCES (111). <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Childs said the Minnesota Toll Road Authority, Inc. is pursuing legislation <br />to allow the tolling of TH61 0 and TH 10 Crosstown. The strategy is to <br />include the toll road legislation in the Omnibus Transportation Bill. <br /> <br />The North Metro Mayors Association is actively exhibiting opposition to <br />the toll road, and help is needed from individual cities to adopt resolutions <br />of opposition to be sent to legislators, Congressmen and newspapers. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING <br />AND ADOPT THE RESOLUTION OPPOSING THE DESIGNATION OF TH610 <br />AND TH1 0 CROSSTOWN AS A TOOL ROAD AND DIRECT STAFF TO <br />FORWARD COPIES TO THE APPROPRIATE OFFICIALS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />City Attorney Charlie LeFevere outlined a request from Champps' Inc. <br />regarding the Brandywine facility lease. <br /> <br />In December 1990, the City sold the Brandywine to the Englesma Trust <br />under a contract for deed. In turn, Englesma Trust entered into a 15 year <br />lease with Champps' Inc. which included a 5 year renew option. The <br />lease entails base rent increases over time. Champps' is responsible for <br />taxes, insurance and expenses. <br /> <br />Currently, upon default of the contract. the City could reclaim the property <br />and is not obligated to honor Champps' lease. Champps' lender is <br />uncomfortable with these terms and has held the closing in escrow <br />awaiting action by the City. The lender has requested Champps' to ask <br />the City for an agreement which, in the event the City reclaims the <br />property, it would honor Champps' lease. <br /> <br />leFevere said a disadvantage in acquiring the lease would be that an <br />unexpected rise in market rates for rentals would leave the Champps' <br />lease at below market rates.
