He <br />found out the property belonged to a homeowners association on the day <br />of closing when he purchased his home. larson said the real estate agent <br />should have noted the homeowners association participation. <br /> <br />Benke understands the homeowners' frustration, but added it is not the <br />City's responsibility or function to advise every prospective homeowner. <br />He fails to see a benefit in accepting the donation. <br /> <br />Anderson related to the Association that the donation would need to be <br />reviewed by the Park Board and formally accepted or denied by the <br />Council. He recalled that the more he reviewed the parcel it became <br />apparent it was not in the best interest of the City. <br /> <br />Motion by Rebelein, seconded by Larson to NOT ACCEPT DONATION OF <br />OUTLOT A FROM THE EAST INNS BRUCK ASSOCIATION FOR PARK <br />PURPOSES AND TO DIRECT STAFF TO WORK WITH THE ASSOCIATION <br />TO EXPLORE OTHER LAND USE OPTIONS FOR THE PROPERTY. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Announcements and Uodates <br /> <br />Council Business <br /> <br />land Donation <br />from East <br />Innsbruck <br />Homeowners <br />Ascn <br />Report 91-26 <br /> <br />Announcements & <br />Uodates <br /> <br />Childs said New Brighton's share of the recent Local Government Aid LGA Reduction <br />(lGA) cuts will be a $74,000 permanent cut. <br /> <br />Childs summarized recent mandates faced by cities this year. Included Mandates <br />are: updating watershed management plans, Hepatitis B Vaccinations, <br />increased water consumption report filing fees, annual school inspections <br />by City Fire Marshal, increased record keeping of Police reports, inclusion <br />of penalty language on handicap parking signs, Pay Equity law compliance <br />costs, Affirmative Action Plan and training, Right To Know law reporting <br />and training, hazardous waste training and equipment, additional seating in <br />fire vehicles, election laws, and Minimum Wage law increases. <br /> <br />Childs said the recent lGA cuts combined with mandates put cities in a LGA Reduction <br />difficult financial position. He noted the need for some form of funding <br />mechanisms for the mandates. The Fiscal Disparity Law and tax base <br />sharing is also becoming an important issue among Metro Area cities. <br /> <br />Childs said one "worst case scenario" could cause New Brighton to <br />receive a $700,000 permanent lGA cut. In analyzing the reduction <br />potential, Childs has imposed a hiring freeze and strict control on capital <br />spending, but stated that such actions are only interim measures. <br />
