There also appears to be considerable oak wilt on the parcel. <br />Gunderman confirmed the only access is through lots 1 and 13. <br /> <br />Steve Jensen, Innsbruck East Association, said the outlot is held in joint <br />ownership among the 75 residences. The Association does not have use <br />for the land and feel it is a liability. To dedicate the land as park property, <br />two-thirds vote is required and there is adequate support for such a vote. <br />To do anything else requires a higher percentage M which is unlikely to <br />happen. <br /> <br />Rebelein asked what benefits would the City receive if the donation was <br />accepted? Jensen said one benefit is the land remaining as open space. <br />He feels the City helped create the situation when it was platted. <br /> <br />Benke said the developer created the outlot as a recreational area for the <br />neighborhood. Jensen said the Association developed the recreational <br />area in 1977, but after being vandalized it was closed in 1982. Williams <br />asked if the Association considered extending the property lines through <br />the adjacent properties. Jensen said this would require a 95% <br />membership vote and doubts it would be supported. <br /> <br />Benke said development of the property is the only benefit, but this is not <br />feasible. Closing the easement may address the liability issues and <br />prevent trespassing. Jensen said there is access from the Fridley border. <br />leFever8 said in order to sell the property to a developer, the City would <br />need to clear all individual easements and receive 100% participation. <br /> <br />Dave Herbert, Innsbruck East Association, feels the situation was created <br />by City action in approving a plat with a parcel of no use to its residents. <br />The homeowners are burdened with paying taxes and liability for a <br />property they receive no benefit from. <br /> <br />Williams said it appears the homeowners' grievance is with the developer <br />who promised to develop the parcel. Because there is no public access he <br />does not see any public benefit from the donation. <br /> <br />Rebelein reiterated that the parcel was not created by the City, but by the <br />developer as an amenity to the development. She noted similar instances <br />within the City where outlots have been created and function well.
