<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />December 13, 1990 <br /> <br />Page 10 <br /> <br />Council Business. continued <br /> <br />Motion by Williams, seconded by Larson. to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING THE SETTLEMENT AND RELEASE <br />WITH THE U.S. DEPARTMENT OF JUSTICE AND AUTHORIZING MAYOR <br />AND CITY MANAGER TO EXECUTE SUCH AGREEMENT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Rebelein said that New Brighton is one of several cities to approve plans <br />for the community access function of community cable television to a <br />private corporation. As the result of the change and the agreement with <br />the company, the ordinance needs to be updated as it relates to the rights <br />and responsibilities of the cable company. <br /> <br />Motion by Larson. seconded by Rebelein, to WAIVE THE FIRST READING <br />AND APPROVE AN ORDINANCE AMENDING THE CABLE FRANCHISE <br />ORDINANCE TO PROVIDE FOR CITY CONTROL OF COMMUNITY <br />TELEVISION PROGRAMMING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Childs said both Champps' and M. R. Moore expressed a desire to open <br />immediately after transfer of Brandywine ownership from the City. <br />However, it is possible that closing may not occur before December 21, <br /> <br />If closing is delayed, Champps' has indicated they would not be interested <br />in operating the facility, but M. R. Moore could begin operations on <br />December 17. Staff recommends authorization of the required licenses <br />upon the assumption that closing will be timely. Extending the required <br />licenses would reduce City liability for the facility. <br /> <br />LeFevere recommends Mayor and Manager enter into a short term lease <br />providing for and allowing occupancy of either Champps' or M. R. Moore. <br /> <br />Motion by Benke, seconded by Williams, to ISSUE CIGARETTE, FOOD <br />ESTABLISHMENT AND ON~SALE SUNDAY SALES INCLUDED <br />INTOXICATING LIQUOR LICENSES TO RENARD VENTURES II FOR <br />DECEMBER 16, 1990 THROUGH DECEMBER 31, 1990; AND ISSUE AN <br />OFF-SALE INTOXICATING LIQUOR LICENSE TO M.R. MOORE INC.
