Benke said that because the project has not been finalized, the <br />City decided to install the fencing and sod in order to protect the <br />wellhouse. City Engineer Les Proper said that if the plans are approved, <br />the City would accommodate the realignment by lowering the grade, <br /> <br />Childs explained that the Powerhouse Bar will be closed as of December <br />1. Staff recommends that the facility's numerous surplus items be <br />available for public auction. The Police Department also has unclaimed <br />property which could be combined with the Powerhouse items. <br /> <br />Council was asked if they feel the facility's furnace should be listed for <br />auction. After discussion, Council agreed that because of the building's <br />probable demolition, all salvageable items should be auctioned off. <br /> <br />Gladys Walbon, 860--6th Avenue NW, feels the Powerhouse Bar should <br />not be closed. <br /> <br />Motion by Williams, seconded by Rebe/ein, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION FOR THE AUCTION OF SURPLUS CITY <br />PROPERTY, WITH SUCH AUCTION TO BE HELD ON SATURDAY, <br />DECEMBER 15TH AT 906--5TH AVENUE NW. <br /> <br />5 Ayes ~ 0 Nayes, Motion Carried <br /> <br />Williams asked what extent is the City responsible upon a possible <br />revocation of the Tri-City charitable gambling license, <br /> <br />LeFevere said that years ago, the City did have a role in licensing <br />charitable gambling, but recent State law changes has pre-empt the City's <br />authority. The City no longer issues licenses, but simply approves the <br />issuance. The City may impose restrictions upon an organization, but <br />currently the City Code does not specify any restrictions. <br /> <br />City approval of an application is needed in order for State approval. If an <br />application is denied by Council, the State can not go forward, LeFevere <br />acknowledged it does put a City in an uncomfortable position being that <br />the State is the primary regulator, and the City would need to defend its <br />actions for denial. The City could adopt an amendment which would give <br />some control and guidance over charitable gambling licenses. <br /> <br />In the Tri-City case, the State has initiated contested case proceedings in <br />alleged violations.
