<br />~ <br /> <br />RESOLUTION NO. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-293. <br /> <br />WHEREAS, an application for a variance has been made by E.M. Corporation; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1 . An application for a variance was filed with the City of New Brighton on July 2, <br />1993. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on August 17, 1993, and all persons present at the hearing were <br />given an opportunity to be heard. <br />3. The City Council considered the application at its August 24, 1993, meeting. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of <br />Fact in respect to VN-293: <br />1. The property is zoned 1-1, Light Industrial. <br />2. The required street sideyard setback in the 1-1 district is 40 feet. <br />3. The proposed building addition would have a street sideyard setback of 32 feet <br />and would require an 8 foot setback variance. <br />4. The existing building was approved and constructed 32 feet from the road <br />easement to the north in 1979. <br />5. The road easement to the north is developed with a driveway, not a public <br />street, which serves several industrial buildings in the immediate area. <br />6. The 40 foot street sideyard setback has been required along the road easement <br />to allow for an adequate distance from any building to the road easement should <br />a public street be constructed in said easement in the future. <br />7. The applicant is requesting the proposed addition be granted an 8 foot variance <br />so it may be setback 32 feet from the road easement to visually match the <br />existing building. <br />8. Strict enforcement of the 40 foot street sideyard setback would cause the <br />applicant an undue hardship due to circumstances unique to the subject <br />property; those being Findings number 4 and 5 above. <br /> <br />BE IT FURTHER RESOLVED, the application for VN-293 is hereby approved subject to the <br />following conditions: <br />1.
