Bar <br />Report 90-177 <br /> <br />3 Ayes - 0 Nayes, Motion Carried <br /> <br />Benke noted receipt of a petition from several Lake Diane <br />homeowners. <br /> <br />Proper said the Lake Restoration and Maintenance Projects Policy has <br />been redrafted by the Environmental Quality Commission (EQC). The <br />new draft refers to Bloomington's policy language and substitutes <br />the 75% special assessment language for the project category table. <br /> <br />The proposed policy refers to water bodies divided into three <br />categories, A, Band C. Funding of Category A and B projects are on <br />an individual basis. Funding of Category C projects are by a <br />combination of assessments levied against shoreline owners and <br />general City taxes. <br /> <br />One resident referred to the pond adjacent to her property which has <br />become polluted by construction and weather runoff from the storm <br />sewer. She noted there has been a lot of drainage from the Seminary <br />Estates construction project. <br /> <br />Brandt Rebelein said the policy does include deviation from policy <br />in some instances. If outside activity caused a problem in water <br />bodies bordered by private properties, the Council may deviate from <br />policy after investigation of the situation. <br /> <br />The resident asked if the effectiveness of drainage systems could be <br />monitored. Proper said the policy allows for the City to initiate <br />a proj ect if the storage volume appears to be inadequate. A <br />feasi bil i ty study woul d be conducted and appropri ate percentages <br />would be determined. <br /> <br />Projects that involve assessments require a formal publ ic hearing <br />which involves mailing meeting notices to residents. <br /> <br />Motion by Brandt Rebelein, seconded by Larson, to APPROVE THE POLICY <br />FOR LAKE RESTORATION AND MAINTENANCE PROJECTS AS PER THE EQC, JULY <br />11, 1990 DRAFT. <br /> <br />3 Ayes - 0 Nayes, Motion Carried <br /> <br />Lake Restoration and <br />Maintenance Projects <br />Policy <br />Report 90-178 <br />
