Site Security: <br /> <br />STAFF COMMENTS <br /> <br />The applicant is proposing to rezone the subject site from R-3B, Multiple Family Residential to B-1, <br />Limited Business and replace the existing townhouse building footings with a 2,859 sq. ft. dental <br />office building. The site plan proposed by the applicant complies with all B-1 district standards. <br /> <br />The proposed building has its main entrance on the west side or 9th Avenue NW side. Therefore, <br />the front yard for the site is located along 9th Avenue NW. <br /> <br />The proposed off-street parking lot is also located along 9th Avenue NW. Therefore, the required <br />setback is 30 feet for the proposed parking lot. The total number of stalls required is 1 9, <br />however, the applicant proposes to construct 10 parking stalls and agree to construct the <br />remaining 9 stalls through a Proof of Parking agreement. If the remaining 9 stalls are constructed, <br />the proposed off-street parking lot would be located 15 feet from the 9th Avenue NW <br />right-of-way. According to the City Attorney, the applicant should be required to apply for the full <br />1 5 foot setback variance even if he does not intend to construct the 9 additional stalls at this <br />time. <br /> <br />The unique circumstance that creates a hardship for the applicant is the irregular shape of the <br />site. This same hardship was recognized by the City Council in 1987 when a 5-foot setback <br />variance was granted for the townhouse buildings and two-family home proposed for the site at <br />that time. As mentioned, the L-shaped subject site was originally platted for townhouses and a <br />two-family home. The required setbacks of the proposed B-1 district from the R-1 boundary line <br />
