<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 26, 1990 <br /> <br />Page 3 <br /> <br />Public Hearing - None <br /> <br />Council Business <br /> <br />Police Chief John Kelley presented the first reading of the Revised <br />Animal Control Ordinance. <br /> <br />In regards to Council IS previous concerns, the "substantial bodily <br />harm" definition has been added and is consistent with the statutory <br />definition. The ordinance treats dogs and cats equally --- neither <br />may run at large, both require rabies vaccinations, and owners of <br />both must clean up fecal droppings on public and private property. <br /> <br />There were no comments from the audience. <br /> <br />Motion by Gunderman, seconded by Brandt, to HOLD THE FIRST READING <br />AND WAIVE THE READING OF AN ORDINANCE AMENDING CHAPTER SIX, ANIMALS <br />AND FOWL, OF THE CITY CODE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />City Engineer Les Proper presented the Lake Sedimentation Removal <br />Report which was prepared by staff and the Environmental Quality <br />Commission (EQC) subcommittee. <br /> <br />The report contains a suggested policy for dealing with resident <br />requests for restoration/improvement projects on small private <br />lakes, ponds, and wetlands. <br /> <br />The subcommittee identified the following restoration/improvement <br />categories: sediment removal, bog removal, reduction/control of <br />nuisance weeds & algae, water quality/increase water clarity, <br />reduction of bottom organic material, shoreline weed removal, odor <br />control and studies. A recommended ranking of public/private cost <br />splits was determined for each category. <br /> <br />Pond improvement projects would be handled by the public improvement <br />assessment process which residents initiate projects by petitioning <br />the Council. The private portion would be special assessed against <br />the shoreland owners and the public portion paid through a general <br />property tax. The process enables the City to sell bonds to finance <br />the project and these bonds are not subject to levy limitation. <br /> <br />Williams noted that Minnesota Statutes and DNR Rules declare any <br />body of water over 2.5 acres in urban areas as public waters. <br />Proper will research the correct term for describing these smaller <br />bodies of water in New Brighton. <br /> <br />Public Hearing <br /> <br />Council Business <br /> <br />First Reading of the <br />Revised Animal Control <br />Ordinance <br />Report 90-48 <br /> <br />Lake Sedimentation <br />Study <br />Report 90-49 <br />
