<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />December 12, 1989 <br /> <br />Page 4 <br /> <br />Council Business, continued <br /> <br />Motion by Benke, seconded by Larson, to APPROVE ISSUANCE OF <br />RESTAURANT ON-SALE LIQUOR AND SUNDAY SALES LICENSES TO EIGHTY, <br />INCORPORATED, D.B.A. ROBERT LEE RESTAURANT, FOR THE PERIOD JANUARY <br />1 THROUGH DECEMBER 31, 1990; WITH SUCH APPROVAL CONTINGENT UPON THE <br />APPLICANT COMPLYING WITH THE TERMS AND CONDITIONS OF THE STATE <br />STATUTE AND THE CITY LIQUOR ORDINANCE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Council Business <br /> <br />Robert Lee Restaurant <br />Liquor License <br />Report 89-302 <br /> <br />Kevin Locke, Community Development Director, presented a report for <br />the proposed purchase of the John Miller property. This item was John Miller Property <br />not originally on the agenda; however, action is required before <br />year end if this purchase is desired. <br /> <br />Mr. Mi 11 er proposes to sell to the Ci ty 17.2 acres of 1 and at the <br />N.W. quadrant of 1-694 and I-35W. He offered to donate half the <br />site to the City and sell the remainder for $1.00 per square foot. <br />He would also accept terms on the sale of the remaining land. <br /> <br />Purchasing this property would give the City control of the largest, <br />single parcel in the Highway 8 Corridor target redevelopment site <br />#9, at a very reasonable price. Acquisition of the Miller property <br />would facilitate redevelopment of the N.W. quadrant of 1-694 and 1- <br />35W. The total price for the property will be $375,000. <br /> <br />The item will be discussed further at the December 26, 1989, Council <br />meeting. <br /> <br />Charl ie LeFevere, City Attorney, reviewed the proposal and feels <br />the transaction would not need to be completed before December 31, <br />1989. If the Council wishes to pursue the proposal, a resolution <br />to accept the donation would be needed before December 31, 1989. <br />After acceptance of the donation by the Council, staff will begin <br />the necessary investigation process. <br /> <br />Benke has received several letters in regard to the adoption of an <br />ordinance relating to the sale of cigarettes. The majority of the <br />letters expressed their opposition to the inclusion of a penalty <br />provision in the proposed ordinance. The penalty provision would <br />make it a petty misdemeanor for minors to purchase cigarettes from <br />a vending machine.
