<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />November 14, 1989 <br /> <br />Page 8 <br /> <br />Council Business, continued <br /> <br />Mr. Briant presented to Council the Coalition's recommended penalty <br />provision, it reads: <br /> <br />Purchase or attempted purchase of tobacco products by minors <br />is prohibited. It shall be unlawful for any person who has not <br />attained the age of 18 years to purchase or attempt to purchase <br />any tobacco product. A person under the age of 18 years who <br />is alleged to have violated this ~ection' shall be subject to <br />the jurisdiction of the Juvenile Court under Minn. State <br />S260.11. In addition to the dispositions otherwise provided <br />by law, a violation of this section shall subject the minor to <br />a fine of $100 for a first violation or $200 for any subsequent <br />violation. <br /> <br />The Coalition will introduce uniform language to the legislature in <br />February. The recommended penalty ordinance will also be <br />introduced. <br /> <br />One provision of the proposal to the state legislature is to post <br />a separate sign on vending machines which warns minors of the <br />penalties associated with purchasing cigarettes. Responsibility for <br />enforcement of the penalties would be assigned to merchants and the <br />local police departments. <br /> <br />The sentence for conviction of selling cigarettes to a minor, the <br />sentence may involve a fine and/or jail term. <br /> <br />Benke noted that present Legislation will only focus on the vending <br />machi ne issue, but he feels that regul ati on of over-the-counter <br />sales should also be considered. Mr. Briant will recommend the <br />i ncl usi on of regul ati ng over-the-counter ci garette sales to the <br />Coalition. <br /> <br />Williams feels the suggested penalty ordinance should be reviewed <br />by Police Chief Kelley. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE FIRST READING <br />OF THE ORDINANCE ADDING SECTION 15-63 TO THE CITY CODE RELATING TO <br />THE SALE OF CIGARETTES FROM VENDING MACHINES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Gunderman suggested that Chief Kelley, City Manager Childs, and City <br />Attorney LeFevere revi ew the pen a lty ordi nance and submit thei r <br />recommendations to the Council. <br /> <br />Council Business <br /> <br />Cigarette Vending <br />Machine Ordinance <br />Report 89-278 <br />Ordinance 572 <br />
