After the first <br />year, spot inspections will be made to ensure compliance with the <br />ordinance. <br /> <br />The proposed ordinance imposes a regulatory measure on cigarette <br />vending machine sales to minors without seriously affecting business <br />operations. <br /> <br />There are approximately 24 businesses in New Brighton with cigarette <br />vending machines. Most businesses have a considerable amount of <br />public contact, but a few of these businesses have machines located <br />in employee lunchrooms or meeting areas. <br /> <br />Benke noted that the April 1, 1990, effecti ve date a 11 ows for <br />implementation of the licensing process. He feels the adoption of <br />the New Brighton ordinance is an excellent idea, but noted a uniform <br />state-wi de code may be more effecti ve. The Apri 1 1990 <br />implementation date may provide the state legislature the <br />opportunity to adopt a uniform state code. The proposed ordinance <br />seems a more workable approach than an all-out cigarette ban. <br /> <br />Severa 1 area bus i nesses have contacted staff about the proposed <br />restrictions and. expressed support of the ordinance. <br /> <br />Wi 11 i ams suggested that the ordi nance be pub 1 i shed in the New <br />Brighton Bulletin. <br /> <br />Mr. Tom Briant, an attorney. representing the Coalition for <br />Responsible Vending Sales and the Minnesota Automatic Merchandising <br />Council, relayed the Coalition's thoughts on the proposed ordinance. <br /> <br />The Coalition applauds the proposed New Brighton ordinance and found <br />it to be very similar to the Coalition's suggested ordinance. <br />Basically, the Coalition feels vending machines should be allowed <br />to serve employees in factories or businesses, businesses which sell <br />alcoholic beverages, and businesses whose machines are v;sable to <br />store clerks. <br /> <br />Council Business <br /> <br />Cigarette Vending <br />Machine Ordinance <br />Report 89-278 <br />Ordi nance 572 <br />
