The property was incorrectly surveyed
and the City consequently took possession of 33 feet more than it
was entitled to take. In addition, the former City Attorney did not
fi 1 e the deed, caus i ng Mr. Perron to pay taxes on Ci ty-owned
property.

One of the opt; ons avail ab 1 e to the City is the purchase of the
property in question. Staff does not recommend this option because
Mr. Perron does not want to sell his land and the land in question
is not necessary to the function of Vermont Park.

Staff is recommendi ng a reimbursement of $612.00 for taxes and
$1,372.00 for "rental" of the property. In addition, the City would
move the park fence to its proper 1 ocati on with i n 30 days of
settlement.

Anderson confirmed that Mr. Perron is satisfied with the recommended
settl ement.

Motion by Williams, seconded by Larson, to APPROVE A SETTLEMENT OF
RAYMOND PERRON'S CLAIM AGAINST THE CITY IN THE AMOUNT OF $1,984.00.

5 Ayes - 0 Nayes, Motion Carried

Anderson presented a request from the Park Board members that they
be appointed to the Community Center Task Force for participation
in the design phase of the project. The Park Board is also willing
to assist the Council and staff in other activities related to the
Community Center.

Staff feels the request is a reasonable one, even through the size
of the Task Force would be enlarged. It would provide additional
expertise and community involvement in the planning process.

Gunderman feels the request is appropriate and the Park Board should
playa major role in the project.

Williams feels the addition of the Park Board would improve the
designing process and generate fresh ideas.

Council Business

Financial Settlement
with Raymond Perron
Report 89-246

Park Board Members
Participation on
Community Center
Task Force
Report 89-247
