. . NONCONFORMING USE PERMIT The existing Type IV nonconformities on the subject property are: 1. The parking lot is not curbed; 2. Lack of enclosed parking stalls; 3. The existing apartment building is only setback 10 feet from the rear property line ( A 30 foot setback is required); 4. The existing dumpsters is not enclosed; 5. The existing parking lot encroaches onto adjacent property in two locations; and 6. The subject site is void of any shrubs, trees, or other landscape material. The applicant proposes to reduce some of these nonconformities by making the following improvements: 1. Provide for 13 enclosed parking stalls; 2. Enclose the existing dumpsters; 3. The applicant's Attorney has obtained parking and driveway easement rights for the two locations where the existing parking lot encroaches onto adjacent property; 4. The provision of new landscaping on the subject site would upgrade said site to meet with current landscaping expectations for new construction. Where Type IV nonconformities are present on a lot, the construction of new structures requires City Council approval. Such permission can only be granted if the City Council determines the number of nonconformities have been reduced to the greatest practical extent. SITE PLAN REVIEW The proposed improvements would bring the parking situation at the subject site into closer compliance with the Parking Ordinance. The appearance of the site would also be improved with the addition of dumpster enclosures and landscaping. RECOMMENDA nON Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF NC-I04, SUBJECT TO CONDITIONS. Motion to RECOMMEND APPROVAL OF LP-318 SUBJECT TO THE FOLLOWING CONDITIONS: 1. APPROVAL OF NC-I04. 2.
