Ken's Market Site - Nonconforming Use Permit <br />The Ken's Market parking lot contains the following Type IV nonconformities; 1) parking stalls located <br />up to the right of way lines of Cleveland Avenue SE and County Road D, 2) no parking aisles, and 3) no <br />concrete curbing. <br />The applicant proposes to reduce the above nonconformities by landscaping a 50 x 50 foot area located <br />on the SE corner of the subject site, thereby, breaking up the continuous bituminous surface which <br />begins at the edge of the paving on Cleveland Avenue SE and County Road D, and continues all the way <br />to the sidewalk which abuts the Ken's market building. Said landscaped area would also serve to increase <br />sight lines at the subject intersection. The corner of County Road D and Cleveland Avenue SE is <br />proposed to be landscaped by the owner in an attempt to reduce the amount of parking and reduce the <br />nonconformities. As part of the minor subdivision, a 50 foot wide section of open space has been <br />provided behind the Ken's Market building to accommodate future development or redevelopment of the <br />Ken's market site. <br />Submittal Details <br />The applicant has agreed to submit a detailed landscape and screening plan prior to the Planning <br />Commission meeting. Said plan will be reviewed by the City Forester and be accompanied by a staff <br />memo. A lighting plan and grading and drainage plan must also be submitted for the Police Chief, City <br />Planner, and City Engineer to review and approve. Also, easements need to be established (legally <br />described) for the proposed sanitary sewer line relocation and the proposed storm water retention pond. <br />RECOMMENDATION <br />Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTIONS APPROVING NC-108, <br />VN-315, AND PL-236, SUBJECT TO CONDITIONS. <br />l <br />Motion to RECOMMEND APPROVAL OF LP-327, SUBJECT TO THE FOLLOWING CONDITIONS: <br />1) SUBMITTAL AND APPROVAL OF A DETAILED LANDSCAPE AND SCREENING PLAN FOR THE <br />PROPOSED OFFICE BUILDING SITE BY THE CITY FORESTER AND THE CITY COUNCIL <br />2) SUBMITTAL AND APPROVAL OF A DETAILED LANDSCAPE PLAN FOR THE 50 X 50 FOOT GREEN <br />SPACE PROPOSED FOR THE KEN'S MARKET SITE BY THE CITY FORESTER AND CITY COUNCIL <br />3) SUBMITTAL AND APPROVAL OF A LIGHTING PLAN BY THE POLICE CHIEF AND CITY PLANNER <br />4) APPROVAL OF THE GRADING AND DRAINAGE PLAN TO BY THE CITY ENGINEER <br />5) RCWD PERMIT APPROVAL <br />6) EASEMENTS BE ESTABLISHED FOR THE PROPOSED SANITARY SEWER LINE RELOCATION AND <br />PROPOSED STORM WATER RETENTION POND, AND <br />7) A BOND OR LETTER OF CREDIT BE SUBMITTED TO THE CITY TO COVER 100% OF THE COST TO <br />INSTALL CURBING, PAVING, AND LANDSCAPING ON THE TECH PRO SITE, AND LANDSCAPING ON <br />THE KEN'S MARKET SITE. <br />8) APPROVAL AND CONTINUING COMPLIANCE WITH NC-108, VN-315, AND PL-236. <br />u , <br />J;QVN <br />• Erny Mattila, City Planner _ <br />G:\CD\-97-PC\-97-RPTS\LP-327.
