<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />August 8, 1989 <br /> <br />Page 4 <br /> <br />.--r <br /> <br />Public.Hearing - None <br /> <br />\;~: <br /> <br />Council Business <br /> <br />Margaret Egan, Fi nance Di rector, presented for consi derati on the <br />certification of the 1990 tax levy and budget. <br /> <br />The Truth in Taxati on Law requi res that the City provi de Ramsey <br />County wi th a proposed tax 1 evy and El90 budget. The Ci ty took the <br />first step in complying with the Truth in Taxation Law at the July <br />25th Council meeting by adopting the tax levy and 1990 budget. <br /> <br />The resolution was forwarded to the County so that they could <br />furnish to the City by August 8th the "no increase and proposed tax <br />rates" data. The Ci ty can modi fy the proposed 1 evy up to August <br />15th, after which time the County is responsible for notifying <br />tbxpayers about the proposed tax changes. <br /> <br />It has been communicated that the County is not expected to furnish <br />the data by the August 8th deadline. The delay of this data makes <br />modification of the proposed levy difficult and impractical. <br />Therefore, to not jeopardize the City I s taxing authority, no <br />modification of the proposed levy is recommended. <br /> <br />In an attempt to clarify the status of the Truth in Taxation Law, <br />the City solicited an opinion from the Attorney General. The <br />opi n ion concl udes that the Commi ssi oner of Revenue may determi ne <br />what acti on consti tutes substanti a 1 camp 1 i ance with the Truth in <br />Taxation Law. Therefore, if a city follows the memorandum entitled <br />"Instructions to Cities", which is the Commissioner's suggested <br />compliance directive, then a community's levy is not likely to be <br />challenged. The directive also allows the City to make its final <br />levy in November, allowing more time for the County to make its tax <br />calculations. <br /> <br />Motion by Benke, seconded by Brandt, to WAIVE THE READING AND ADOPT <br />THE RESOLUTION CERTIFYING TAX LEVY AND 1990 BUDGET IN COMPLIANCE <br />WITH THE TRUTH IN TAXATION LAW. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Public Hearing <br /> <br />Council Business <br /> <br />Certification of 1990 <br />Tax Levy/Budget - <br />Attorney General's <br />Opinion <br />Report 89-201 <br />Resolution 89-103 <br />
