i <br />ti <br />RESOLUTION No. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A PORTION OF THE FIRST STREET <br />'NW RIGHT-OF-WAY. <br />j WHEREAS, the procedural history of the application is as follows: <br />1. City of New Brighton represents 100 percent of the property owners involved to vacate the <br />described right-of-way. <br />2. That the City Council, pursuant to published notices, held a public hearing on the vacation, and all <br />persons present at the hearing were given an opportunity to be heard. <br />Now, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON makes the <br />following Findings of Fact in respect to the proposed vacation: <br />1. The street right-of-way to be vacated is improved, but no longer serves a public purpose, and is <br />impeding the development of the Brighton Corporate Park II area. <br />BE IT FURTHER RESOLVED, the Council hereby vacates that portion of the First Street NW right-of- way <br />lying east of Fifth Avenue NW and legally described as follows: <br />That part of First Street NW which lies easterly of the east right of way line of Fifth Avenue <br />NW and westerly of the westerly right of way line of Interstate Highway No. 35. <br />The City is to retain a drainage and utility easement over the above described proposed right <br />of way vacation. <br />All in the City of New Brighton, Ramsey County, Minnesota. <br />;Adopted this 8th day of July, 1997. <br />ATTEST: <br />ATTEST: <br />Margaret Egan, <br />Finance Director/City Clerk <br />(Seal) <br />r <br />Robert Benke, Mayor <br />Matthew S.
