1

I

1

Council Meeting Minutes
May 9, 1989

Page 6

Council Business

Williams asked if the clearing of these parcels would resolve any
further problems which may delay the developer's plans. Locke said
a condemnation hearing was held on Friday, May 5th. The title
insurance company indicated, based on the court action, they would
issue a lenders title insurance policy and a owners policy for the
site. The condemnation process in which the City pays the claimant
directly, seems to be the speedier method. A clear title to this
property is now in place.

Williams asked if Mr. Jerry Svee has been notified of the
proceedings and is aware of the title insurance company's actions.
Locke veri fi ed that the acti on taken at the condemnati on heari ng
does not involve the Svee property. The condemnation hearing for
the Svee property will be held on June 5, 1989. The Svee property
includes a claimant who is no longer in business. Because of this,
the City is required to publish a public notice in order to acquire
this piece of property.

Larson asked the details of the possible judgement lien listed on
the report. Locke said the 1 ien is associated with a lawsuit
brought against the City several years ago. Issues relating to the
interested parties listed on the report have been resolved.

Mati on by Wi 11 i ams, seconded by Larson, to AUTHORIZE PAYMENT OF
$3,400.00 TO MILDRED TRAPP FOR HER INTERESTS IN ANY AND ALL PROPERTY
WITHIN T.I.F.
