I I I Council Meeting Minutes February 14, 1989 Page 5 Public Hearing The applicant wishes to construct a swimming pool on the southeast corner of hi s property. A 20 foot wi de drainage and util ity easement area would be retained along the rear property line. This easement would allow for drainage and flowage into the ponding area. In exchange for this vacated easement. the applicant would dedicate an equal amount of lot area for ponding purposes on the southwest corner where there is currently a retention pond. The proposed swap woul d allow the app 1 i cant use of the elevated portion of the lot. while the drainage easement would be expanded to include the ponding area. Benke confirmed that basically this request is a vacation and a dedication. Williams asked if there would be a problem with the existing wet land on the east part of this site. Mattila said that both vacations being considered this evening are neighboring properties. The vacation of the Christianson site. and the easement area to be dedicated with the Lien site; would reflect how the storm water is retained on the property. The wet land area outlined on the diagram is not reflective of the current drainage situation. Benke verified that this request is to dedicate the corner currently designated wet land on the diagram. Williams noted that the diagram is incorrect and it no longer reflects the current situation, Mattila explained that the lot and the marsh area have been graded and fi 11 ed. Being no comments from the audience. Motion by Gunderman. seconded by Brandt to CLOSE THE PUBLIC HEARING. 4 Ayes - 0 Nayes. Motion Carried Motion by Benke. seconded by Williams to WAIVE THE READING AND ADOPT THE RESOLUTION VACATING A PORTION OF THE DRAINAGE AND UTILITY EASEMENT LOCATED AT 1571--27TH AVENUE NW. 4 Ayes - 0 Nayes.
