Benke further <br />explained according to the development agreement, if the property <br />owner disagrees with the City's appraisal; the City will compensate <br />for the cost of an appraiser of the owner's choice to make a second <br />appraisal. If here still is a dispute after the second appraisal, <br />a formal proce s with a neutral party will determine the owner's <br />compensation. Benke said this process is to ensure accurate <br />appraisals of p operty. <br /> <br />Mr. Yempa aske if the development agreement is approved tonight, <br />would his prop rty become condemned? Benke verified with Norris <br />that it takes s parate action by the Council to condemn a property, <br />and this would be done after the other appraisal is completed. <br /> <br />Mr. Paul Skjerv ld, the attorney representing Liquid Scale, said he <br />wrote letters t Anne Norris and Jack Bagley, Relocation Specialist. <br />On December 9, 1988, Mr. Skjervold had spoken to Mr. Bagley about <br />the Winfield M'tchell appraisal. ~lr. Skjervold instructions from <br />his client, Liquid Scale, is to fight the acquisition of this <br />property. <br /> <br />I <br /> <br />Mr. Skjervold eels under these circumstances, the City does not <br />have the right to acquisition since the property is not a blighted <br />area. His appe rance at the meeting is to inform the Council of his <br />client's objet ions to the acquisition of this property. <br /> <br />Moti on by Wi 11 . ams, seconded by Larson to WAIVE THE READING AND <br />ADOPT THE RESO UTION APPROVING AND AUTHORIZING THE EXECUTIVE OF A <br />DEVELOPMENT AG EEMENT WITH WELSH COMPANIES. <br /> <br />5 Ayes - 0 Nay s, Motion Carried <br /> <br />Erny Matti 1 a, City Pl anner, presented the second readi ng of the <br />proposed parki g standards. <br /> <br />On November 2, 1988, the Counci 1 gave a fi rst readi ng to a <br />resolution ado ting new parking standards. To date, the community's <br />reaction to th proposed parking standards has been positive.
