Locke <br />acknowledged, that since the land was not cleared, the City has not <br />been aggressively looking for other developers, and feels there is <br />no one interested at this time. <br /> <br />Benke comm nted, at this time of the year, it may make it more <br />attractive to pursue other parties. <br /> <br />Locke sugg sted, if the deve 1 opment agreement is extended, the <br />Council should require a non-refundable deposit and a firm deadline <br />date. <br /> <br />Given the history of this property, Benke feel reluctant to <br />terminate he agreement at this time. <br /> <br />Wi 11 i ams a ked, if the staff feel comfortable wi th the proj ect <br />proposed. Locke said, staff has not found a problem in the proposed <br />project. <br /> <br />Wi 11 i ams ommented that the app 1 i cant seems fairly ser i ous in <br />developing this property, and suggested extending the agreement with <br />a firm dea line. <br /> <br />Larson and Brandt both agree with extending the agreement, but with <br />a firm dea line with a non-refundable deposit. <br /> <br />Motion by Brandt, seconded by TO AMEND THE AGREEMENT AND GRANT A <br />EXTENSION UTHORIZING THE CONTRACT FOR PRIVATE DEVELOPMENT WITH CBA <br />RESIDENTIAL DEVELOPMENT, LTD. IN SECTION 3.3 PARAGRAPH A, TO READ <br />JANUARY 3 , 1989. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Item #5 ( equest of Consideration of Resolution to Waive Fees for <br />liCe 1 ebrat Mi nnesota 199011 proj ect) from the Consent Agenda were <br />presented for discussion by Brandt. <br /> <br />Brandt as ed LeFevere his interpretation of the wording of the <br />resolutio which states the City agrees to pay and\or waive all fees <br />related t the moving and the renovation of the New Brighton depot <br />during 19 9.
