Under Section 475:44,. Variations and Exceptions, the Planning Commission may <br />recommend variations from t ese requirements in specific cases which, in its <br />opinion, do not affect the general plan or the intent of this ordinanceo -Such <br />recommendation shall be communicated to the council in writing, substan- <br />tiating the recommended variations, The Council may approve variations <br />from the requirements- of this ordinance in specific cases which, in its opinion, <br />do not adversely affect the plan and spirit of this ordinance, <br />It would appear that because of the. near double size of the lots formed by the Sub- <br />division as proposed and the feet that lots platted prior to the adoption of Vi I lage of <br />New Brighton Ordinance 1$$ which meet at least 75°l0 of the width,. length and area <br />required in the platrting ordinance (See 188, Section 3-140, Non Conforming Lots of <br />Record) are held to be buildable- lots, the granting of such a variation in lot width <br />would noa, in our opinion adversly affect the plan and spirit of this Ordinance <br />(Vil lage'of New Brighton Code, Section 475:00) , A stipulation should, however, <br />be attached indicating that no additional variances be granted to develop the lot <br />as proposed. in this plat with regard to setback. minimums etc. <br />Attachments <br />1.
