The new bu ildable lot which will come <br />into being with the filing of this plat will be the West 1/2 <br />of an existing 66.5+ foot wide lot which is at present an <br />unplatted parcel. <br />The .developer has requested the waiving of the platting <br />requirement of producing a topographic map of the property. <br />Section 475:44 of the Village Code (Platting Ordinance) <br />states that the Planning Commission may recommend variation <br />from the platting requirements in specific cases which, in <br />its opinion, do not affect the general plan or intent of the <br />Ordinance. <br />The general topography is high in relation to 20th Avenue N.W. <br />and the lot slopes and drains to 20th Avenue N.W. and to the <br />North. It appears that material (dirt) has been taken from <br />the center of the parcel. This lot and those North of it have <br />possibly been used as a borrow pit. We do not know when the <br />property was "graded", however, the removing of material from <br />this property without a permit is a violation of Village Code <br />Section #875. <br />The size of the plat and the fact that all improvements are <br />in and that no grading is required other than that which is <br />normally required in conjunction with the building of a house <br />and as such is permitted, is the basis for the request for the <br />variation.
