Partyka questioned the desirability of allowing the access at <br />all. <br />Motion by Partyka, seconded by Bohling to amend themotion by deleting <br />that portion which reads "unless Ramsey County requires that we permit <br />it in which case this exit should be posted to allow right turns only." <br />Amendment carried 3-2 (Formell, Mann) <br />Partyka commented that it si the Planning Commission's feeling that <br />operation of a nursery school shoulc be permitted under the special <br />use permit being requested. <br />Motion as amended carried 5-0 <br />ADMIN?STRATIVE DISCUSSION <br />The application for the Special Use Permit lists three uses for the <br />property in question. Two of the three, church and Sunday school, <br />definitely fall within the category of permitted special uses in an <br />R-1 district. Nursery schools, however, are a permitted special use <br />only in R-3 zones. The question, then, which has already been raised <br />at the Planning Commission meeting is whether the nursery school is part <br />of the church use and therefore permitted in an R-1 district, or whether <br />it is to be treated as a separate use which wouldinot be permitted <br />except in an R-3 district. <br />A related question is whether this use has already been "grandfathered" <br />in since the property may have been put to this use before the present <br />ordinance was enacted. <br />A question has also been raised regarding the number and location of <br />driveways. Section 1045:15 limits the maximum number of driveways to a <br />single property to two (2) unless a permit for a greater number is <br />obtained. The proposed plot plan shows three driveways. One of these <br />driveways provides access to the property from Silver Lake Road. <br />The Village Engineer is concerned about the advisability of accessing <br />the property directly onto a major street such as this when it could be <br />easily channeled to a controlled intersection at Rice Creek Road and <br />Silver Lake Road. The Planning Commission has also recommended against <br />this access as it conflicts with the statement in the "Transportation <br />and Thoroughfares" section of the Comprehensive Plan that "access to <br />private property from arterials should be discouraged although it may <br />be permitted to large developments." Changes in the number or placement <br />of accesses could be made a condition of the Special Use Permit. <br />It should also be noted that the Planner was incorrect in stating that <br />the proposed additional uses appear to be in keeping with the purpose <br />for which the original Special Use Permit was issued."
