Arden Hills did approve the consulting agreement <br />with McGinley upon contingent of their City Attorney's approval. <br /> <br />LeFevere expl ined that the Arden Hills approval of the consulting <br />agreement was made before the liability and indemnification issues <br />were received and also their City Attorney is out of the country. <br /> <br />Gunderman ask d LeFevere if the City is protecting itself upon the <br />approval of t ese agreements. LeFevere said these agreements would <br />be reviewed with the City's insurance company before Council <br />approval. WITH MCGINLEY AND ASSOCIATES. <br /> <br /> <br /> <br />yes, Motion carried. <br /> <br />Page 9 <br /> <br />Council Business <br /> <br />Joint Agreement with <br />Arden Hi 11 s for <br />Rendering Plants <br />Report 88-298 <br />Resolution 88-118 <br /> <br />Consulting Agreement <br />with McGinley/Ascts <br />for Rendering Plants <br />Report 88-299 <br />Resolution 88-118 <br /> <br />Kevin Locke, gave a brief update regarding the Rendering Plant Air Rendering Plant Update <br />quality and PCA permits. The three rendering plants are: Gordon <br />Rendering, T e Mengelkoch Company and Kem Milling Company. Gordon <br />and Mengelko h are located in New Brighton and Kem Milling in Arden <br />Hills. <br /> <br />In the permi process, Gordon and Kem failed the stack standards <br />tests and ha e submitted compliance plans. Mengelkoch did pass the <br />standards te ts, but City Staff has questioned the validity of <br />testing proc dures, and the Minnesota Pollution Control Agency is <br />reviewing th test results. <br /> <br />Charl es McGi 1 ey, Consultant, and Dave Fri dgen, City Sanitari an, <br />have reviewe the compliance plans from Gordon and Kem Rendering <br />Plants. Als, McGinley and Fridgen have met with representatives <br />from the Gordon and Kem Rendering Plants and MPCA, but no action has <br />been taken 0 the submitted compliance plans. The Staff has raised <br />several cone rns on what should be required for compliance. Staff <br />is expectin reaction from the MPCA regarding the possible <br />acceptance 0 these compliance plans. <br />
