<br />SP-57 <br /> <br />-3- <br /> <br />November 12, 1974 <br /> <br />We have been told that the Metropolitan Airports <br />Commission may have some authority and concern regarding this <br />matt(~r, though we have no definite information at this time. We <br />will attempt to have further information by meeting time. <br /> <br />We also have a slight concern that the towers might tend <br />to be an attractive nuisance. They are unusual structures that <br />might draw the attention of motorists because of their extreme <br />visibility in this location. Such distraction of motorists could <br />lead to accidents and further hazard to New Brighton residents. <br /> <br />Our last concern relates to the potential interference <br />the transmitter could create in the surrounding area. According <br />to the Federal Communications Commission, they do not review <br />each request with regard to this question but they do not expect <br />any major problem. There is some potential for blanket <br />interference within .1 mile of the tower. According to the FCC <br />there is a general condition on all licenses that the station <br />resolve any interference problem within this distance. It is <br />also possible to file a complaint with the FCC to have a specific <br />condition put on the license req~ing resolution of problems of <br />this type. Obviously, the Council could put a similar condition <br />on the special use permit. Whether the City Should have further <br />concern in this area we do not know as we do not have sufficient <br />expertise on the staff. If the Council is seriously concerned <br />about this point, it might wish to retain the services of an <br />expert. <br /> <br />If, after considering these various questions, the Council <br />should decide to approve the permit, we would ask that the Council <br />consider adding the following conditions to the approval: <br /> <br />1. The City will retain, at the applicant's expense, <br />an engineer qualified to review the plans and inspect <br />the construction of the proposed towers. Our <br />Building Inspector is not qualified to review and <br />inspect construction of this type. At present, <br />such capability also does not exist in the State <br />Building Inspector's office, though after the first <br />of the year it may become available. <br /> <br />2. Any ar~ of bare earth, including any areas graded <br />or filled, should be seeded. <br /> <br />3. The area should be fenced. <br />
