If there were interference, <br />he noted that filters could be used. <br />Mr. Erickson noted that the F.A.A. received no comment from <br />the Highway Patrol as it circularized the application. He <br />stated that the attractive nuisance theory is a difficult <br />on to accept since there are many similar towers located <br />in the metropolitan area. He indicated that he felt there <br />would be no detrimental effect to surrounding people and <br />that he had spoken with the people in the area and they did <br />not appear to be concerned. He noted that soil conditions <br />have been a problem in sale of the property but that would <br />not be incumbrance in construction of the tower. <br />Mr. Erickson further presented the Council with an artist's <br />rendering of the appearance of the tower from 10th Street N.W. <br />He expressed concern that the HRA had no plans for the area <br />and that if the permit were rejected on this basis all <br />building permits requested in the area should be treated in <br />a similar fashion. <br /> <br />Mr. John Miller, owner of the property, discussed soil <br />condifions indicating that in certain areas there was from <br />20~25 feet of trash fill and that the property is covered <br />with a great deal of peat taken from freeway excavation. <br />Mr. Erickson expressed the feeling that the tower would be a <br />benefit to the community and that Northwestern College is <br />agreeable to landscaping the site. Additionally, he indicated <br />that the college would be agreeable to giving open space <br />easements to the City for recreational uses. <br /> <br />Mayor Bromander asked why this site was chosen rather than <br />the 96 acre campus. The petitioner responded that the campus <br />does not fit the need because of the ground system necessary <br />for the buildings. It was the petitioner's feeling that there <br />is not sufficient space available on the campus and the <br />topography would create some problem. It was added that no <br />specific study had been conducted relative to the campus property. <br />Mayor Bromander asked what had happened to the alternate site. <br />The petitioner's response was that the request for rezoning on <br />the alternate site had been denied and added that that site was <br />no longer satisfactory. <br />Mayor Bromander asked whether the original proposal for a 700 <br />foot tower was necessary for the long-term planning. The <br />petitioner responded that their current plans are not <br />contingent on the 700 foot tower and that presently the <br />F.A.A. have inclined to deny the request for a 700 foot tower. <br />Mayor Bromander asked whether the college intended to increase <br />the power from 1000 watts to 5000 watts on the AM transmitter. <br />The petitioner indicated that he felt the F.C.C. will approve <br />such ,an increase and additionally the increase from 50,000 to <br />100,000 watts on the FM transmitter. <br />
