<br />council Proceedings <br />Ci~y,~f New Brighton <br />Nov. 12, 1974 <br /> <br />5 <br /> <br />Mr. Jay Davis, 2350 Tioga Court, expressed his earlier concern <br />that the house was not compatible with the area and does not <br />suit the land on which the house would be placed. He <br />expressed further concerns as to the potential effects of <br />drainage on his property. He asked what kind of siding would <br />be used and the petitioner responded that wood siding is <br />proposed and that the overhang would be extended <br /> <br />Motion by Fisher, seconded by Eagon to close hearing ,close Hearing <br />5 ayes - 0 nayes- carried <br />Motion by Bromander, seconded by Fisher to grant SP-59 <br />contingent on the following conditions: <br />1. That a $10,000 bond be posted to insure that the <br />structure is brought to code and that it is completed in <br />substantial compliance with the site plan and rendering <br />signed and dated November 12, 1974 by the Building and <br />Planning coordinator and by the petitioner. <br />2. That the house have wood siding as depicted in the graphics: <br />3. That the basement be enlarged by 8 feet as shown on <br />the rendering and be enclosed; <br />4. That the portion above the existing basement may be <br />either enclosed or open porchi <br />5. That the overhang be constructed as shown on the <br />rendering (2 feet) <br />4 ayes - 1 naye (Rebelein) - carried <br /> <br />Attorney stated hearing was properly called. <br />Mr. Keith Harstad, petitioner, described the proposed <br />plat and the reasons that the layout was made as it was. <br />He indicated that he would deepen the pond in order to <br />accommodate abutting property owners. He indicated he <br />would move Mimosa Court 10 feet to the west and would <br />locate homes as far to the west as possible to better <br />accommodate the drainage situation. Mr. Harstad further <br />noted that the open space area could either be donated to the <br />city or be under the control of the Home Owners Association <br />which could include the Forestdale neighborhood. <br />Motion by Anderson, seconded by Eagon to receive letter <br />from F. R. Siegfried, et ale <br />5 ayes - 0 nayes - carried <br />Mr. Leroy Wozniak, 749 Forestdale Road, presented a <br />petition to the Council <br />Motion by Fisher, seconded by Rebelein to receive petition <br />5 ayes - 0 nayes - carried <br />Mr. Wozniak read the contents of the petition. <br />Mr. Harold Anderson, 737 Forestdale Road, presented a <br />statement to the Council. <br />Motion by Rebelein, seconded by Fisher to receive <br />statement <br />5 ayes - 0 nayes - carried <br />Mr. Anderson read the statement to the Council <br /> <br />SP-58 and <br />PL-95 <br /> <br />10:26 to <br />12:37 <br />
