Location: Apartments 113, 115 and 117, Bri9htonVillaqe Apartments 902 West County Road D Discussion: On July 10, 1973 the city Council approved a special use' permit for the applicant to operate a day care center and nursery school in the Brighton Villa~ Apartments. The motion granting this permission was as follows: "Motion by Eagon, seconded by Anderson, to grant special use request as presented. Motion by Fisher, seconded by Rebeleinto amend above motion to state limit of special use permit for two years. I 5 ayes - 0 nayes - carried Vote on. amended motion - 5 ayes - 0 nayes - carried" The nursery school has been functioning since 1973 and we have received no complaints in regard to it from neighbors in the apartment complex nor from nearby single family homes. In terms of our own code enforcement programs, there are some minor housing code violations. which are to be corrected by the end of this month and the applicant has been given a notice by the State Department of Health to make certain improvements to the food preparation equipment in the nursery school which order the City Sanitarian will be enforcing. The applicant has been cooperating with the Sanitarian in working 'on both of these prOblems. Outside of these items, we have had no .problems at all in regard to the nursery school operation. planninq Commission Consideration 6-17-75: The Chairman read the background discussion. Mr. Steven Gotf was present to represent the applicant. He stated tha.t they are, presently serving 56 children and that they are .'"
