<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />August 9, 1988 <br /> <br />Williams felt very uncomfortable about approving this plat because <br />of a previous proposal several years ago and asked is this current <br />proposal differed at all from the previous one. Williams sited <br />the former proposal was declined because of poor soil conditions <br />and the inadequate layout of homes. Locke mentioned in some <br />instances a building official would require a soil test and <br />documentation of buildable soil conditions before granting a <br />building permit. <br /> <br />Gunderman asked Mr. LeFevere, City Attorney, his legal opinion if <br />the City would be liable for poor construction on this site. <br />LeFevere felt the City would not be liable for improper <br />construction of surface existing conditions by approving the plat, <br />but suggested disclosure of possible potential problems. <br /> <br />Benke suggested amending the resolution conditions to read: <br /> <br />Motion by Williams, seconded by Benke to AMENO RESOLUTION TO REAO: <br /> <br />E. The following requirements must be compli,ed with prior to <br />building permit issuance: <br /> <br />1) <br /> <br />As each dwelling unit is presented for a building <br />permit, the plans must be reviewed and approved by <br />staff; including the review and approval of the <br />foundation and waterproofing designs. <br /> <br />5 Ayes - 0 Nayes, Motion carried. <br /> <br />Mr. Gordon Hedlund, Developer, agreed with the amended conditions <br />and felt there would not be problems involved in this development. <br /> <br />Motion by Brandt, seconded by Williams to WAIVE THE READING AND <br />APPROVE AS AMENDED THE RESOLUTION OF FINDINGS OF FACTS AND LEIER <br />ESTATES #2 (PRD-51) (PL-176). <br /> <br />5 Ayes - 0 Nayes, Motion carried. <br /> <br />Mattila presented the Rezoning of Harstad property (R-133). The <br />rezoning of this property would establish a reasonable land use <br />pattern, adequate street systems, proposed park, and provide for a <br />buffer between 1-694 and the dwellings to the north. <br /> <br />Mr Briggs, Harstad Companies, reviewed the construction plans <br />which include: 1,100 - 2 bedroom and 2 bath apartments, each with <br />1,250 square feet (300-400 larger than average apartment); several <br />upscale townhouses $160,000-$180,000; and expensive single family <br />homes.
