<br />:'t <br /> <br />" <br /> <br />Public Hearing <br />SP-66 <br />December 9, 1975 <br />8:15 PM <br /> <br />Request: ~pproval of Special Use Permit for Setting up a Fun <br />Center (Recreational Center) containing >Recr~ationa1 <br />Devices such as Foosbal1, Air Hockey, Pool and Pin Ball <br />(S ee ,A t tachmE"n t) <br /> <br />Applicant: James Rocheford, Gerald Nes1und, Roger Lammi <br /> <br />Location: West of Silver Lake Rpftd between Rice Creek Road ano <br />Mississippi Strept <br /> <br />Discussion: The applicant is requesting a special permit for the <br />operation of a recreation center in the building formerly occupied <br />by Speedy Market just south of Taco John's on Silver Lake Road. <br />According to Section 11~210 a recreation center operated as a <br />business is a permitteo special use in a general business district. <br />The property in question is zoned for general business use. <br /> <br />A business of this type is obviously going to be a gathering <br />place for teenagers and unless >proper1y supervisec'i, can be a serious <br />problem for the neighborhood as a whole and for the Police Depart- <br />ment. -The Police Department is concerned about the operation <br />of this particular business. While we have not had this exact type <br />of business elsewhere in New Brighton in the past, an existing <br />business did install some amusement devices of the type that are <br />proposed to be located in this business, and a large number of <br />problems were experienced as a result of the activities of teen- <br />agers who came to use these machines. Further, a member of the <br />Planning Commission has done some checking with regard to similar <br />types of businesses in two nearby communities and has found that' <br />sbme problems have existed. His report is attached. <br /> <br />The Police Department has suggested two conditions that it <br />would likp to see attached to any approval of a special use permit <br />of this type. The first would require the hiring of an off-duty <br />police officer during the evening hours to maintain orCler on the <br />premises. The second would bE" that no one 'under the age of 18 <br />years of age would be permitted on the premises. The applicant <br />has objected strenuously to thE" second condition on the grounds that <br />virtually all of the businf'ss for this type of- an establishment <br />comes from teenagers under the age of 18. The issue in regard to <br />this application is, of course, whether it meets the conditions <br />
