<br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />June 28, 1988 <br /> <br />I <br /> <br />Motion by Gunderman, seconded by Larson, to APPROVE THE REFINED COST <br />ESTIMATE FOR THE EMERGENCY VEHICLE PRE-EMPT SYSTEM AND AUTHORIZE THE <br />PREPARATION OF PLANS AND SPECIFICATIONS; AND WAIVE THE READING AND <br />ADOPT A RESOLUTION AUTHORIZING THE USE OF RESERVES FOR THAT PORTION <br />OF THE ENGINEERING COSTS NOT ELIGIBLE FOR M.S.A. FUNDING. <br /> <br />5 Ayes - 0 Nayes. Motion carried. <br /> <br />Page 10 <br /> <br />Les Proper, City Engineer, reviewed the reasoning behind requiring Agreement/Streets, <br />the consultant work for the City rather than the developer, i.e. better Utilities/Brighton <br />control of the public street and utility installations. In response Corporate Park <br />to a question by Mayor Benke relative to requiring another Letter Report 88-204 <br />of Credit, the City Attorney advised that the Letters of Credit now Resolution 88-72 <br />on file with the City do not cover the services of a consultant. <br />Mr. Proper noted a copy of the Agreement had been sent to Mr. Senden, <br />however, he had not yet received any comment from him. <br /> <br />The City Attorney recommended the following amendments be included <br />in this and other similar agreements: <br /> <br />1. Developer shall pay to the City, $2,000 to cover legal <br />expenses and administrative costs. <br /> <br />Developer shall provide usual financial back-up for Plans <br />and Specifications prepared by the Engineer. <br /> <br />3. Contract shall include the right of the City to reject <br />unsatisfactory work and materials; and require replacement. <br /> <br />2. <br /> <br />4. Completion dates, final acceptance of work, and acceptance <br />of utilities will be by resolution of the City Council. <br /> <br />5. Developer will indemnify and hold harmless the City. <br /> <br />Motion by Benke, seconded by Williams, to APPROVE WITH ADDITIONS BY <br />THE CITY ATTORNEY; AND AUTHORIZE EXECUTION BY THE MAYOR AND CITY <br />MANAGER, AN AGREEMENT FOR PUBLIC STREET AND UTILITIES INSTALLATION <br />IN BRIGHTON PARK. <br /> <br />5 Ayes - 0 Nayes. Motion carried. <br /> <br />Announcements and Updates <br /> <br />Mayor Benke introduced Mac Meade as the new New Brighton reporter <br />for the Bulletin. <br /> <br />There will be a special meeting covering the Charter Commission's <br />funding request on Thursday, June 30th, 7:30 A.M. at Perkins on Co. <br />Rd. D. <br /> <br />Bulletin Reporter <br /> <br />RCLLG Charter Comm. <br />Meeting. <br />
